TR-04-15 Resolution Establishing a Municipal Waterways Improvement and Maintenance Fund per Chapter 40 Section 5 G of the General Laws of Massachusetts.&lt;br /&gt;

MOTION BY: Councilor Uliano seconded by Councilor Kraunelis to approve for first read. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Willette motioned for a public hearing on this item. (No seconded) &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Corey Rahme asked if boats are not being taxed. &amp;lt;br&amp;gt;&lt;br /&gt;
Mayor Pollard stated they are taxed. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Corey Rahme asked if the hundred per-cent from the city taxes split (50-50) is to take care of the maintenance of the waterway? &amp;lt;br&amp;gt;&lt;br /&gt;
Mayor Pollard said that state law requires the city to bifurcate the income from boat excise. Half goes into the general fund and half goes into waterways improvements dredging and cleaning. &amp;lt;br&amp;gt;&lt;br /&gt;
City auditor Thomas Kelly stated that a question came about in the treasure’s office because an individual paid late and there was a penalty assessed. Treasurer called his office and asked how they should allocate that revenue. The law states (chapter 60 B) &lt;br /&gt;
that half is put in the general fund and the other half be put in a special account (to split it) allocate it (correctly) for waterways and maintenance clean up. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Campbell asked it this is a new tax? &amp;lt;br&amp;gt;&lt;br /&gt;
Mr. Kelly stated this is not a new tax and is mandated by state law. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Willette asked for a written report on the issue, explaining the background. He has read the law but would like to have a letter attached with more information. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Hennessy asked if the fee has been increased. Is it the same only divided? &amp;lt;br&amp;gt;&lt;br /&gt;
Mr. Kelly stated it has not increased. It is state law that it is divided. This will offset any emergency that may happen. There may be a damn or river causing a water problem we will have a fund that is the law. We have collected to date $9,665.65. Half of that will be in the water fund $4, 800.00. &amp;lt;br&amp;gt;&lt;br /&gt;

MOTION BY:� Councilor Uliano, seconded by Councilor Condon to adopt. &amp;lt;br&amp;gt;&lt;br /&gt;
Councilor Willette thanked Thomas Kelly, City Auditor, for the timely submission of the report. It was very straight-forward. &amp;lt;br&amp;gt;&lt;br /&gt;
